To withdraw nondiscriminatory treatment (normal trade relations treatment) from the People's Republic of China.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. FINDINGS.

The Congress finds that--

(1) an incident occurred in international airspace between a United States military aircraft and a Chinese jet fighter on April 1, 2001;

(2) the United States military aircraft was an EP-3E, a large propeller-driven aircraft incapable of high speeds, that was struck by a highly-maneuverable Chinese F-8 fighter jet capable of traveling at twice the speed of sound;

(3) due to damage, the United States military aircraft was forced to make an emergency landing on Hainan Island, People's Republic of China;

(4) the United States military personnel were removed from the aircraft by Chinese military personnel and taken to undisclosed locations; and

(5) the Chinese Government has failed to promptly release the 24 United States military personnel.

SEC. 2. WITHDRAWAL OF NORMAL TRADE RELATIONS TREATMENT FROM THE PEOPLE'S REPUBLIC OF CHINA.

Notwithstanding the provisions of title I of Public Law 106-286, title IV of the Trade Act of 1974, or any other provision of law, effective on the date of the enactment of this Act, normal trade relations treatment shall not apply to the products of the People's Republic of China, and normal trade relations treatment may not thereafter be extended to the products of that country.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. REVOCATION OF AUTHORITY TO EXTEND PERMANENT NORMAL TRADE RELATIONS TO THE PEOPLE'S REPUBLIC OF CHINA.

(a) REVOCATION OF AUTHORITY- Sections 101 and 102 of Public Law 106-286 are repealed.

(b) CONFORMING AMENDMENTS- Public Law 106-286 is amended--

(1) in division A, by striking the division heading and the heading for title I and inserting the following:

`DIVISION A--RELIEF FROM MARKET DISRUPTION

`TITLE I--RELIEF FROM MARKET DISRUPTION';

and

(2) in the table of contents, by striking the items relating to division A and inserting the following:

`DIVISION A--RELIEF FROM MARKET DISRUPTION

`Sec. 101. [Repealed]

`Sec. 102. [Repealed]

`Sec. 103. Relief from market disruption.
